Clarification Regarding Vehicles

On March 16, 2004, the Homeowner’s Board voted to approve the following regulation for the purposes of clarifying the restriction on commercial vehicles as contained in the Declaration of Covenants, Conditions and
Restrictions for Hampton Place:

No commercial vehicles, house trailer, mobile home, motor home, recreational vehicle, trailer or like equipment shall be permitted on any Lot on a permanent basis, but shall be allowed on a temporary basis for a time period not to exceed forty-eight (48) consecutive hours, inclusive of one (1) night. For the purposes of this Section, “temporary” shall mean a one-time event and shall not be deemed to include a regular or recurring pattern of behavior. 

Furthermore for the purpose of this Section, the term “commercial vehicle” shall be deemed to include, but not be limited to the following:


Panel trucks, panel vans, vans (excluding mini-vans), buses, vehicles with a load capacity of one (1) ton or more, vehicles with commercial writings on their exteriors, vehicles that are used primarily for commercial purposes, vehicles with tool racks, boxes, or other fixtures intended for commercial purposes. Notwithstanding the foregoing, any such vehicles or equipment may be stored on a Lot, provided such vehicle or equipment is kept in a garage and is concealed from view by neighboring residences and streets pursuant to plans and specifications approved by the Board of Directors of the Association or its designated committee.

Please be advised that the above regulation is currently in effect and will be enforced accordingly.

Additionally, the adoption of the Georgia Property Owners Association Act (POA) has been approved by the requisite two-thirds (2/3) approval of the membership. The Association will be subject to the POA once the necessary documents have been filed in the Gwinnett County land records.
